Rapid Response Network in Santa Clara County Protests ICE’s Latest Attempt to Deny Immigrants Right to Due Process

Morgan Hill, CA- The Rapid Response Network in Santa Clara County, along with impacted families, immigration lawyers, religious leaders and other allies, will gather on Thursday, December 20th at 12 pm to denounce ICE’s latest tactics aimed at denying immigrants their right to due process and call for the closure of the Morgan Hill office.  The group will conduct a delegation to deliver a cease and desist letter to the Morgan Hill office.

Last week, it was reported that immigrants taken to the ICE Morgan Hill detention center are forced to wait upwards of five hours in ICE vehicles – without access to counsel- until transported to San Francisco for processing. The Morgan Hill facility does not have a “safe” place where those detained can speak to an attorney and earlier this month, attorneys were refused access to the facility, forcing those in ICE custody to wait for legal advice until they arrive in San Francisco. As such, a large number of detainees are coerced to give in to the pressures of ICE and sign a voluntarily departure without having the benefit of speaking to a lawyer. By withholding access to legal assistance and implementing stalling techniques coupled with inhumane conditions, ICE is violating detainees’ Constitutional right to due process.   

In addition, the Morgan Hill detention center lacks the resources necessary to guarantee the humane treatment and safety of detainees.  Deaths of immigrants while under the custody of immigration officials have spiked and just last week, a 7 year old girl was the latest victim.
